APAP (Anti-Piracy Action Program) is: an effective approach to copyright infringement; an approach that embra ces technology rather than squelching technological advances; an eight step program that provides a low-cost, user-friendly answer to piracy that is available to all adult producers/distributors, big and small.
Step 1: Upon subscribing, members will receive: • a copyright assessment; • an action plan for ensuring that all copyrights are properly registered; • information/education on how to register copyrights.
Step 2: FSC has negotiated: • bulk purchases of infringement identifying technological services with top content tracking vendor Vobile; • services at a significant savings for subscribers; • services made available and affordable for all subscribers regardless of size. • for titles to be searched daily on ten targeted tubesites • the availability for content providers to track their titles on Vobile’s website using their participant specific user ID and password.
Step 3: FSC will: • coordinate the delivery of take down notices for all infringements detected through Vobile’s content tracking; • ensure that all notices are on attorney letterhead with the signature of an attorney; • maintain a database of correct contact information of UCG/tubesites once identified, ensuring offenders receive take down notices as quickly as possible.
Step 4: As infringing locations are identified FSC will: • compile information and distribute it to all subscribers; • track notices sent to any given site in order to determine which locations are the biggest violators; • document how sites respond to take down notices and how quickly they do so.
Step 5 FSC will: • negotiate with third party vendors and UCG sites to prescreen user uploaded content; • coordinate monetization of previously infringing activity; • ensure technology and service is available to all subscribers regardless of size.
Step 6 FSC will: • review ownership, analyze business practices and compile data for infringing sites; • work with subscribers to determine an individualized approach for each infringing site; • identify subscribers, when appropriate, who wish to engage in litigation and match them with others to form litigation groups.
Step 7 Research, Education and Outreach FSC will: • research piracy and anti piracy trends and technologies and keep subscribers informed, through a monthly on-line newsletter; • research new technologies for locating infringing content and will interface with technology companies to explore new solutions; • communicate with mainstream entertainment attorneys, the MPAA, and mainstream production companies.
Step 8 FSC will develop a seal or mark that Anti-Piracy Program subscribers can place on their products (DVDs, websites) to warn would-be infringers that the studio is among those taking collective efforts to protect content and prosecute infringement claims.
