SIGNIFICANT DONATION TO 2257 DEFENSE FUND
CANOGA PARK, CA -- FSC has acknowledged the latest major contributor in the fundraising drive for the 2257 Legal Defense Fund. World Wide Content, Inc (www.worldwidecontent.com) set aside a percentage of sales over a period of time that ultimately totaled many thousands of dollars. The money will go exclusively to the fund.
“I know I sound like a broken record,’ said FSC Executive Director Michelle Freridge, “but the truth is, without the expenditure of effort and passion that companies like World Wide Content put forth to raise money in support of this legal challenge, our lawyers would not have been able to achieve what they have so far, which is to keep the federal government at bay with every expectation that we will ultimately prevail in court. Efforts like this inspire us and help galvanize others in the adult community to similar action.”

BUCKEYE ACE SCORES AGAINST ARCH ENEMY
COLUMBUS, OHIO -- Ohio Senate President Bill Harris has re-referred HB-23, a highly controversial bill which would broaden adult business regulations and extend regulatory powers to townships, to the Rules Committee, an unusual move. The ostensible reason for the re-referral action was that time was needed to give members more time to review related issues and close a potential loophole.
However, Harris made no secret of his opinion of the actions of Phil Burress and his Cincinnati-based nonprofit censorship organization, Citizens for Community Values (CCV). In the days leading up to the likely vote on the law in the Senate (it has already passed in the House by a vote of 92-5), Burress sent out emails stating that his group’s planned Political Action Committee (PAC) would “make sure every Republican who stood in the way of (HB 23) passage will have to answer to voters. Maybe in the form of a primary.”
It appears likely now that any vote on HB-23 will take place after the November elections. Harris said the suggestion that members opposing the bill could face primary opposition wasn’t a key factor in his decision to move the bill. “But I am very possessive, being the president of the Senate, of my members,” he said. “And when I feel that my members are being put in the position of being challenged inappropriately, I’m going to make sure I stand up for those members.”
The CCV email and plans gained a high profile when complaints were filed by the Buckeye Association of Club Executives through lobbyist Neil Clark, who complained to both the Ohio Elections Commission and the Legislative Inspector General. The complaints accused the CCV of using improper lobbying tactics to threaten state senators into favoring the legislation as well as violating restrictions on political activity by nonprofit organizations.
“In their capacities as spokespersons for CCV, Phillip and Vickie Burress have used CCV and its charitable, tax-free status… to conduct activities that are designed to influence the election of candidates for public office,” Clark said.

HARRIET MIERS STEPS ASIDE
WASHINGTON, DC Harriet Miers has withdrawn her nomination to be an associate justice on the Supreme Court, citing issues of constitutional separation of powers because senators were demanding the release of internal White House documents. Some believe that rationale was a face saving ploy for a nomination that was in trouble.
Others say the decision was forced by right-wing conservatives in the Republican party.
“[U]ltraconservatives are so determined to swing the Supreme Court sharply to the right that they pounded their own president’s nominee into submission, and now demand a nominee with unquestioned far-right credentials,” said Ralph G. Neas, President of People For the American Way.
It is also possible that social conservatives have miscalculated, that Harriet Miers would have been a reliable, dream vote for their causes -- had they trusted Bush’s inside knowledge of he - and that the President, known for pride and stubbornness, will now nominate someone to spite the Christian Right, someone easily confirmable, with credentials like Chief Justice John Roberts, a clear friend of business interests (which is Bush’s true constituency) but someone who has no well-defined social conservative agenda.

ADULT STORES INDICTED FOR OBSCENITY
ANDERSON, SC -- A grand jury here has indicted four adult businesses, Pandora’s Boxxx, Lucy’s Love Shop, 4 Your Eyes Only and Paradise, on obscenity charges.
Ingo Stugg, owner of 4 Your Eyes Only, said he has been in business in Anderson for 10 years.
How come we have licenses for years and years and they suddenly come out with these things?” Stugg said. “Where are we going where all these churches can tell us what we can and can’t sell? We pay our taxes the same as anybody. If you don’t like it, then look the other way.”
Reverend Elva Martin, who organized the Anderson Prayer Task Force, claimed a victory.
“This is just the beginning of what could happen in our state,” said Martin. Her group led the opposition to the adult shops.

UPDATE ON ADULT PROGRAMMING ON STUDENT TV
SAN DIEGO, CA -- Last week we reported that Steve York’s sexually explicit Koala-TV program would return to Student Run Television (SRTV) at the University of California San Diego despite the opposition of the University Administration. As promised, a defiant Steve York proceeded to air about a half-hour of footage of himself engaged in sex with an unidentified adult actress while dozens of students at the campus pub watched on closed-circuit monitors and cheered.
Since then, however, the student council held a special meeting and, by amending the charter, declared nudity and sexual depictions banned. (The station charternow amendedhad said that, while obscene broadcasts are not allowed on SRTV, indecent broadcasts are, if aired between 10 p.m. and 6 a.m.) In addition, according to York, the council is threatening to dissolve Koala TV as an organization, freeze its funding, fire the station manager, and kick Steve York out as a producer and member.
The university administration has delegated to student leaders the responsibility of clarifying and enforcing SRTV’s charter, reasoning that the station’s $8,000 annual budget is funded by student fees.
By outward appearances, the administration’s hands are clean of censorship, since the decision to ban the show was made by the student council. York claims that there was little public input and many of the senators were absent.

PROBATION FOR POSSESSION OF ANIME COMICS
EDMONTON, CANADA -- Gordon Chin was prosecuted here under Canadian child porn laws after customs officials discovered explicit anime comic books in a package being sent to Chin’s home. Under Canadian law, child porn includes “visual representations” of children in sexual situations. In the United States, of course, child porn laws are based on the sexual abuse of actual children.
No doubt the extreme nature of the cartoon imagery played a part in the prosecution, reportedly including images of naked, tied-up children and babies being raped with pistols.
“Why would anyone want to look at stuff like this?” asked Judge David Tilley. “I don’t think this is the kind of filth that should be available to the public.”
Chin pleaded guilty to possession but claimed ignorance of the fact that the content was illegal in Canada. And since there was no evidence that Chin planned to do anything with the materials other than look at them in the privacy of his home, he avoided jail time. Chin was placed on probation for 18 months and required to complete 100 hours of community service.

BILLBOARD LAW HOLDS UP AGAINST CHALLENGES
KANSAS CITY, MO -- U.S. District Court Judge Gary Fenner has ruled that a Missouri billboard law limiting adult ads is constitutional. The law, adopted in 2004, applies to billboards promoting businesses that involve naked workers or use more than 10 percent of the premises to display sexually oriented material. The law requires such signs to be at least one mile away from a state highway. Lion’s Den Adult Superstore had claimed that the law was overly broad and restricted adult businesses from advertising not only adult items but nonadult products as well. Lion’s Den had wanted a sign that said: “Lion’s Den Superstore Food Fuel Adult Exit Now.”
Perhaps the proposed sign would have been legal had the word “adult” been deleted. Fenner said in this opinion that the law “does not prohibit sexually oriented businesses from advertising non-adult items.”
In August, Passions Video attempted to have the law overturned on constitutional grounds, but Fenner said the law was a constitutionally permissible regulation of commercial speech.

BOYS CAN’T HELP IT
ALBUQUERQUE, NM -- Prosecutors here have dropped felony charges against two 18-year-old men who racked up a $2460 tab during their first-time visit to an exotic dance club and then were unable to pay. Craig Everett and Malik Wakji were arrested after they each got 41 songs worth of lap dances in a VIP room. Wakji had $50 and a credit card with a $500 limit. Everett had, according to police, no cash or credit cards; “just a surprised look on his face.” The young men said they were unaware that the $20 lap dances lasted only as long as a song played. Everett said he “thought the dance was just one continuous dance.” That lame argument convinced Beralillo County prosecutors, who let the pair off the hook.
